Terms of Service - HandmadeV

1. Introduction

Welcome to Handmadev.com ("Platform", "Service", "we"). Handmadev.com is a social network platform for the handmade creative community, where users can discover, share, save, and interact with content about handmade arts, creative design, and DIY ideas.

By accessing or using Handmadev.com, you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to any terms, please stop using the Platform.

2. Conditions of Use

2.1 Minimum Age

You must be at least 13 years old to create an account and use the Service (in compliance with COPPA — Children's Online Privacy Protection Act).
If you are between 13 and 17 years old, you need the consent of a parent or legal guardian before using the Service.
We reserve the right to request age verification and disable accounts if a violation of age requirements is detected.

2.2 Account Creation

You must provide accurate, complete, and up-to-date information when registering an account.
Each individual is only allowed to own one (01) account on the Platform.
You are responsible for securing your login information (password, 2-step authentication codes) and all activities that occur under your account.
You must notify us immediately if you detect any unauthorized access to your account.

2.3 Account Responsibility

You may not share, transfer, or sell your account to anyone.
You are fully responsible for all content posted, shared, or stored through your account.

3. User Content

3.1 Content Ownership

You retain all intellectual property rights to original content that you create and upload to the Platform ("User Content"), including but not limited to: images, posts, tutorials, design patterns, and comments.
By uploading User Content, you grant Handmadev.com a non-exclusive, royalty-free, transferable, sublicensable, worldwide license to use, copy, distribute, display, modify, and create derivative works from that content for the purpose of operating, developing, and promoting the Service.
This license terminates when you delete the User Content or delete your account, except where the content has already been shared by other users or needs to be retained for legal reasons.

3.2 Prohibited Content

You may not upload, share, or transmit any content that:

a) Violates the law:

Violates Vietnamese law or applicable international law.
Promotes illegal activities, trafficking in prohibited goods.
Infringes on copyrights, trademarks, patents, or intellectual property rights of third parties.

b) Harmful content:

Adult content, pornography, violence, horror, or offensive material.
Hate speech, discrimination based on race, gender, religion, ethnicity, or any form of prejudice.
Harassment, bullying, threats, or invasion of others' privacy.
Misleading information, misinformation, or fraudulent content.

c) Dangerous content:

Instructions for using dangerous materials (toxic chemicals, explosives...) without proper safety warnings.
Content encouraging self-harm or endangering oneself and others.

d) Spam and abuse:

Spam, unauthorized advertising, disguised affiliate marketing.
Content automatically generated by bots or automation tools without human supervision.
Duplicate, low-quality content that does not provide value to the community.

3.3 Handmadev.com's Rights Regarding Content

We have the right (but not the obligation) to review, moderate, edit, or remove any User Content that violates these Terms without prior notice.
We may use automated technology (including but not limited to: content filters, spam detection, image quality checks) to assist in moderation.
The decision to remove content or handle violations is the final decision of Handmadev.com.

4. Community Guidelines

4.1 General Principles

When using Handmadev.com, you commit to:

Respect all members of the community, regardless of background, gender, religion, or viewpoints.
Share responsibly: only post content that you have the right to use or have been authorized by the creator.
Give credit: always clearly credit the source when sharing content that is not yours.
Be constructive: contribute constructive comments and encourage creativity.
Be honest: provide accurate information in tutorials, product descriptions, and personal information.

4.2 Prohibited Behavior

You may not:

Impersonate another person or organization.
Use your account to collect data or personal information from other users (scraping, crawling).
Interfere with, damage, or disrupt the operation of the Platform, servers, or infrastructure.
Attempt to gain unauthorized access to systems, other user accounts, or restricted data.
Use bots, automated scripts, or third-party tools for mass interaction (mass like, mass follow, mass comment) with the Platform.
Create multiple accounts to evade bans or engage in fraudulent voting/reporting.
Abuse the violation reporting (report) feature to harass other users.

5. Copyright and Intellectual Property

5.1 Handmadev.com's Ownership

The Handmadev.com Platform, including interface, design, logo, source code, brand name, and all content we create, is intellectual property owned by Handmadev.com and is protected by Vietnamese intellectual property law and international conventions.
You may not copy, modify, distribute, sell, or rent any part of the Platform without written permission from us.

5.2 Copyright Infringement Complaints

If you believe that content on the Platform infringes on your intellectual property rights, please use the Report feature or send a takedown request to our contact email.
A takedown request should include: a description of the infringed content, proof that you are the owner or legal representative, and a link to the infringing content on the Platform.
We will review and respond within 7-14 business days from when a valid request is received.

5.3 Repeat Violation Policy

First violation: written warning, removal of infringing content.
Second violation: temporary account suspension for 30 days.
Third violation: permanent account deactivation.

6. Features and Services

Handmadev.com provides features including but not limited to:

Post content (Pin): share images, posts, handmade tutorials.
Collections: create and manage themed content collections.
Social interaction: like, save, comment, follow, share.
Discover (Feed): browse and discover content from the community.
Profile: manage personal information and identity on the Platform.
Report violations: report content that violates community guidelines.
Notifications: receive information about activities related to your account.

We reserve the right to change, update, suspend, or terminate any feature of the Service at any time, with or without prior notice. We will endeavor to notify users at least 14 days in advance for major changes that significantly affect the user experience.

7. Violation Handling

When a violation of the Terms is detected, Handmadev.com may apply one or more of the following measures:

Warning: send a warning notification to the violating account.
Content removal: remove or hide the violating content.
Feature restriction: temporarily limit the ability to post, comment, or interact.
Account suspension: temporarily lock the account for a specified period.
Permanent deactivation: delete the account and all related data without refund.

You have the right to appeal a violation handling decision within 15 days from the date of notification by sending an email to our contact address. Appeals will be reviewed and responded to within 7 business days.

8. Disclaimer

The Platform is provided on an "as-is" and "as-available" basis.
We do not guarantee that the Service will operate continuously, error-free, uninterrupted, absolutely secure, or free of viruses/malware.
Handmadev.com is not responsible for content uploaded by users, including the accuracy, legality, and appropriateness of such content.
Links to third-party websites on the Platform are provided for reference purposes. We are not responsible for the content, privacy policies, or activities of third-party websites.
In all cases, Handmadev.com is not liable for any indirect, special, incidental, consequential, or punitive damages, including but not limited to: data loss, loss of profits, loss of reputation, or business damages.

9. Termination

You may stop using the Service and request account deletion at any time through Account Settings or by contacting us directly.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent behavior, or harm the community or Platform.
We reserve the right to terminate inactive accounts (no login) for more than 24 months, after sending a reminder email at least 30 days in advance.

10. Changes to Terms of Service

We reserve the right to update or modify these Terms at any time.
Important changes will be notified via email and/or notification on the Platform at least 14 days before taking effect.
Your continued use of the Service after changes take effect means you accept the new Terms.
If you do not agree with the changes, you have the right to stop using the Service and request account deletion.

11. Applicable Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.
Any disputes arising from or related to these Terms shall be resolved through negotiation first.
If negotiation is unsuccessful within 30 days, the dispute shall be submitted for resolution at the competent People's Court in Vietnam.
